General Terms and Conditions
Prices:
The Prices for the Goods or Services include VAT, and other taxes or duties. A delivery charge will displayed at the checkout section of our website when you have entered your postcode.
The Company shall have the right to adjust its prices for any increase in the price of materials, parts, labour, and transport.
Despite our best efforts, a small number of the items on our website may be mispriced. If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.
Carriage:
Included to mainland UK unless otherwise stated. Delivery times are shown on the product page and in the checkout area. Title:
Title to the goods shall remain vested in us until payment has been made for such goods in full. We are authorised to enter any premises where such goods are stored for the purpose of exercising its rights to retake possession of goods for which payment is outstanding.
Conditions of Sale:
All products and materials are sold as being as nearly as possible in accordance with the Supplier’s published description, specification or sample. In the event of any failing to comply with the appropriate description, specification or sample, the Supplier will replace but will not in any event be liable for any other loss whether consequential or otherwise.
Customers must satisfy themselves before using any material that it is suitable for their purpose and the Supplier will not be responsible for any loss incurred by the use of unsuitable material.
Delivery:
Delivery times are shown on the product page and in the checkout area. Some products are delivered on pallets or in 1 tonne bags, in which case lorries are used and a kerbside delivery only can be guaranteed. We will do our best to deliver as close to the property if access allows.
We are not able to carry materials up paths or to rear gardens. Access to sites must be on hard roads over which a vehicle can pass without sustaining or causing damage of any kind.
It is the customer’s responsibility to let us know if there are access difficulties, low bridges, narrow single lanes, weight limit roads, steep driveways or hills. Please call 01347 810022 / 07967 274344.
We will make every effort to deliver products ordered on the agreed date, but if for any reason we are unable to deliver then no liability whether in damages or otherwise for delay of whole or any part of the goods ordered arising from any cause whatsoever.
Delivery shall be conditional upon access free from encumbrances and good roads being available to the company’s vehicles to the place of delivery. If we or the delivery agent cannot gain access to the delivery address then additional costs may be incurred. In the case of kerbside deliveries the customer, or somebody appointed by the customer, should be at the delivery point to accept the delivery unless otherwise arranged.
Force Majeure:
If the Supplier is prevented from or delayed in delivery owing to inability to obtain necessary transport, or owing to labour disputes, strikes, lock-outs, fire, accident, Act of God, breakdown of plant used in the production or delivery or from any cause the Supplier shall not be liable for any loss or damage direct or indirect caused to the buyer by reason or failure or delay by the Supplier in delivering the materials.
Customer’s Premises:
The customer will at all times be responsible for the security and insurance of the products after a delivery has been made.
The customer will comply with all requirements of Health & Safety Legislation. For delivery made on a kerbside delivery basis it will be the customer’s responsibility to move the products from the place of delivery to the area of laying. The supplier accepts no responsibility for injury or damage caused to persons or equipment whilst on customer’s premises.
English Law:
These conditions and any contract or variation are governed by the law of England. Any disputes arising from these conditions or any contract or variation entered into by the company with the customer which cannot be settled in the ordinary course of business shall be referred to a single arbitrator in accordance with the arbitration act 1950 or any modification thereof for the time being in force.
